By accessing or using GammaPay's services, website, or applications (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Services. We reserve the right to update these terms at any time, and continued use constitutes acceptance of any modifications.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. By using GammaPay, you represent and warrant that you meet these requirements and that your use complies with all applicable laws and regulations in your jurisdiction.
3. Account Registration
To access certain features, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You agree to notify us immediately of any unauthorized use of your account.
4. Services Description
GammaPay provides cryptocurrency payment processing, wallet management, invoicing, and related blockchain infrastructure services. We act as a technology provider and do not hold custody of your funds beyond what is necessary to process transactions. All blockchain transactions are subject to network fees and confirmation times outside our control.
5. Fees and Payments
Our fee structure is transparent and published on our pricing page. Fees may include transaction processing fees, withdrawal fees, and subscription fees for premium features. We reserve the right to modify our fee structure with 30 days' prior notice. All fees are non-refundable unless otherwise stated.
6. Prohibited Activities
You agree not to use our Services for any unlawful purpose, including but not limited to: money laundering, terrorist financing, fraud, or any activity that violates applicable sanctions or export control laws. We reserve the right to suspend or terminate accounts engaged in prohibited activities without prior notice.
7. Intellectual Property
All content, trademarks, logos, and intellectual property associated with GammaPay are owned by or licensed to us. You may not reproduce, distribute, or create derivative works without our prior written consent. Your use of the Services does not grant you any ownership rights in our intellectual property.
8. Limitation of Liability
To the maximum extent permitted by law, GammaPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim. We are not responsible for losses resulting from blockchain network failures, market volatility, or third-party actions.
9. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association. You agree to waive your right to a jury trial and to participate in class action lawsuits. The arbitration shall be conducted in English and the decision shall be final and binding.
10. Termination
Either party may terminate this agreement at any time. Upon termination, you must cease all use of the Services and withdraw any remaining funds within 30 days. We may terminate or suspend your access immediately if you violate these Terms or engage in prohibited activities.
